Mixed Directions: Local and State COVID-19 Response

On Monday, the city declared that Austin regressed back to Phase 4 from Phase 3. This change occurred because Austin-Travis County surpassed 20 new COVID-19 hospital admissions per day for a 7-day average.

Stage 4 includes the recommendations for Stage 3 and advises individuals they are safe to return to work, and dine and shop, only at “expanded essential businesses.”

Despite the change in phasing, these procedures are only recommendations.

Governor Greg Abbott’s executive order regarding COVID-19 response supersedes any local orders, so any actions more restrictive than the governor’s order can only be strongly encouraged rather than enforced.

Austin Mayor Steve Adler and eight other Texas mayors have petitioned Gov. Abbott to enforce the use of face coverings. This sentiment was echoed by the judges on the Travis County Commissioners Court during Tuesday’s regular meeting discussions.

At this time, Gov. Abbott is maintaining his current order in part due to the current available supply of hospital beds. Currently, 28% of Austin hospital beds are available, but Austin public health officials worry about the future availability if infection rate doubles in the coming weeks following the increase of large gatherings.

Face masks and other precautions join the long list of disagreements between local governments and the state. Previous disagree including the status of sanctuary cities and property tax caps.
